1. General provisions
1.1. This document is an official public offer (hereinafter — the “Offer”) by [LEGAL NAME] (hereinafter — the “Seller”) to enter into a retail sale contract for flower products and related delivery services with any individual or legal entity (hereinafter — the “Buyer”) on the terms set out below.
1.2. In accordance with Article 437 of the Civil Code of the Russian Federation, this Offer addressed to an indefinite circle of persons constitutes a public offer.
1.3. Acceptance of this Offer occurs when the Buyer:
- places an order through the website ekb-flowers.ru; and
- checks the box confirming acceptance of this Public Offer and the Terms of Use; and
- checks the box confirming consent to personal data processing (where applicable).
1.4. From the moment of acceptance, a contract of retail sale (hereinafter — the “Contract”) is considered concluded on the terms of this Offer.
1.5. Definitions:
- Website — ekb-flowers.ru and its localized pages.
- Order — the Buyer’s request to purchase selected products with specified delivery details.
- Products — fresh flower bouquets, add-ons, and related items listed in the online catalog.
- Delivery — courier delivery of Products to the address specified by the Buyer.

Bank/payment details will be published when online payment (YooKassa) is enabled.
3. Subject of the Contract
3.1. The Seller undertakes to transfer ownership of the Products selected by the Buyer in the catalog, and to deliver them to the agreed address, and the Buyer undertakes to accept and pay for the Products under this Offer.
3.2. Product descriptions, photos, and prices are published on the Website. Some images may be AI-generated or styled references showing mood, palette, and style — not an exact one-to-one copy. Natural variation in flowers (variety, shade, bloom stage, stem placement, wrapping) is normal and does not by itself constitute a defect if the delivered bouquet matches the intended style and overall value.
3.3. If specific flowers are unavailable, the Seller may make substitutions while preserving the overall style, similar colours where possible, and the same or higher value.
4. Order placement and confirmation
4.1. The Buyer selects Products, delivery zone, date/time window, and contact/delivery details in the checkout form on the Website.
4.2. Before submitting the Order, the Buyer must confirm:
- acceptance of this Public Offer and the Terms of Use; and
- consent to personal data processing as described in the Privacy Policy.
4.3. After submission, the Seller may contact the Buyer to clarify delivery details (address, access, timing).
4.4. The Seller confirms availability, delivery details, and total cost before fulfilment. The Contract price is the total shown at checkout (products + delivery fee − applicable discounts).
4.5. Custom or non-catalog requests may be arranged via the Contact page under separate agreement.
5. Prices and payment
5.1. All prices are shown in Russian rubles (₽) including applicable taxes unless stated otherwise.
5.2. Delivery fees depend on the zone selected at checkout and are shown before order submission.
5.3. Online payment via YooKassa will be available later. Until then, payment terms (prepayment, payment on delivery, or other) are agreed individually when the Seller confirms the Order.
5.4. When online payment is enabled, payment is made through YooKassa. The Seller does not store full bank card details.
5.5. The Seller may change catalog prices at any time. The price fixed at the moment of Order acceptance applies to that Order.
6. Delivery
6.1. Delivery terms (zones, hours, same-day rules, address requirements, recipient availability, re-delivery, photo confirmation, force majeure) are set out in detail in the Delivery Policy, which forms an integral part of this Offer.
6.2. Summary:
- Hours: 09:00–20:00 (no night delivery).
- Zones: Yekaterinburg and surrounding areas shown at checkout (including Verkhnyaya Pyshma, Pervouralsk, Beryozovsky, Aramil).
- Same-day delivery is possible when ordered with sufficient lead time, stock is available, and a courier slot is free. Orders after 18:00 are usually scheduled for the next day.
- The Buyer is responsible for accurate delivery data (recipient, address, access instructions, phone).
- At arrival, the recipient should accept the bouquet within 15 minutes; the courier will not wait on site longer than 30 minutes total. Extra waiting or re-delivery caused by the Buyer/recipient may incur additional fees agreed in advance.
- If the actual address differs from the agreed zone/address and causes extra cost, the Seller will contact the Buyer before proceeding.
7. Quality, claims, returns, and cancellation
7.1. Flowers are perishable goods. Claims for damage, poor quality, or non-delivery must be reported promptly with photos and order details via the Contact page.
7.2. Full rules for refunds, replacements, cancellations, substitutions, and non-eligible cases are in the Refund / Replacement Policy, which forms an integral part of this Offer.
7.3. Summary:
- After bouquet preparation or courier dispatch has started, a full refund may not be available.
- Change-of-mind cancellations after confirmation may not qualify for a full refund.
- Approved refunds (when online payment is live) are returned to the same payment method where possible; processing may take 5–14 business days.
- Until online payment is enabled, refund terms for approved cases are agreed individually.
8. Personal data
8.1. Personal data is processed to fulfil Orders and for customer support. Details, legal bases, retention, and Buyer rights are in the Privacy Policy and Cookie Policy.
8.2. Marketing email is optional and requires a separate opt-in at checkout.
9. Liability
9.1. The Seller is liable under the laws of the Russian Federation for failure to perform or improper performance of the Contract.
9.2. The Seller is not liable for delays or failures caused by force majeure, traffic, weather, road closures, incorrect/incomplete Buyer data, recipient unavailability, or access restrictions beyond the Seller’s control, provided reasonable efforts were made to deliver.
9.3. The Seller’s liability for direct damages is limited to the amount paid for the relevant Order, except where mandatory consumer protection law requires otherwise.
10. Disputes and governing law
10.1. Disputes are resolved through negotiations. If no agreement is reached, disputes are subject to the courts of the Russian Federation at the Seller’s location, unless mandatory consumer rules provide otherwise.
10.2. This Offer and the Contract are governed by the laws of the Russian Federation, including the Civil Code, the Law on Consumer Rights Protection (ЗоЗПП), and applicable e-commerce rules.
11. Changes to the Offer
11.1. The Seller may update this Offer by publishing a new version on the Website. The version effective at the time of Order acceptance applies to that Order.
11.2. Continued use of the Website after changes constitutes acceptance of the updated Offer for new Orders.
12. Integral parts of this Offer
12.1. The following documents also apply to this Offer and the Contract:
- Terms of Use — website rules, use of photos and content, substitutions, possible delivery delays;
- Delivery Policy;
- Refund / Replacement Policy;
- Privacy Policy and Cookie Policy.
12.2. If documents conflict for a specific Order, this Offer and the total confirmed at checkout prevail, except where mandatory consumer protection law requires otherwise.
